Variances. . Martin v. Heidelberg Township, Commonwealth Court, May 17, 2018. The court reversed the grant of a variance by the trial court from a requirement that the proposed use be located on a collector road. The court found no evidence of the inability to make other uses of the property that would not require collector road frontage. It seems the Court analyzed this as a use variance rather than as a dimensional variance, likely because the outcome would determine the permitted use. Though road standards are dimensional in nature, the road requirement in the ordinance does have locational aspects.
