Land Development. . On April 19, 2018 the Commonwealth Court decided that a driveway to a proposed shopping center should be treated as a public street for setback purposes because the Township was requiring that the developer improve the driveway to street standards and then dedicate it to the Township. As a result the Court agreed with objectors that a proposed bank pad site failed to meet the required 85 foot setback from a public street. Brandywine Village v. East Brandywine Township.
