Exclusionary Zoning. Ripeness. . Pennsylvania’s Commonwealth Court has ruled that a municipality may not refuse to consider an exclusionary zoning challenge to its ordinance on the basis that the landowner has not yet obtained federal and state permits for its proposed use. Penneco wanted to convert a gas well into an injection well, a use that was prohibited throughout the municipality.
