Standing To Appeal. In an interesting standing case, the Commonwealth Court has held, consistent with prior cases, that objectors cannot appeal a case that they "won" at the trial court (denial of approval was affirmed). Objectors did not agree with a few trial court determinations that did not change the outcome and appealed those issues. They were concerned that those determinations would be applied to the impending revised plan. The court held they need not worry because they would not be estopped from raising those points on the future plan because they were not essential to the judgment (denial). Brandywine Village Associates v. East Brandywine Township Board of Supervisors decided January 5, 2018.
